1) Acceptance of These Terms
These Terms of Service (“Terms”) govern your access to and use of the websites, forms, communications, and services provided by Refuge Memorial (“Refuge Memorial,” “we,” “us,” or “our”). By accessing or using our services, you agree to these Terms. If you do not agree, do not use our services.
2) Eligibility
You must be at least 18 years old and able to enter a binding contract to use our services. You represent that the information you provide is accurate and complete.
3) Services; No Professional Advice
Our services include information, scheduling, communications, and customer support related to our offerings. Content is provided for general informational purposes and does not replace personalized counsel or legally required disclosures. We may modify, suspend, or discontinue any part of the services at any time.
4) Accounts and Security
If you create an account or submit information, you are responsible for maintaining confidentiality of your credentials and for all activity under your account. Notify us immediately of any unauthorized use or security breach.
5) Your Responsibilities
You agree not to: (a) violate laws; (b) infringe others’ rights; (c) upload malicious code; (d) interfere with the operation or security of the services; or (e) use automated means to access the services except as explicitly permitted.
6) User Content
If you submit content (messages, forms, documents), you grant us a non-exclusive, worldwide, royalty-free license to use, host, store, reproduce, and display it solely to operate, improve, and provide the services. You represent you have the necessary rights to the content you submit.
7) Consent to Electronic Communications and E-Sign
You consent to receive communications from us electronically (including email, SMS/MMS, and in-product notices) and to the use of electronic signatures and records in connection with our services. You may withdraw consent by contacting us, but we may be unable to provide certain services if you do.
8) Mobile Messaging (SMS/MMS) Program
By providing your mobile number and opting in on our website, forms, or by texting an opt-in keyword, you consent to receive text messages from Refuge Memorial. Message frequency varies. Message and data rates may apply.
Opt-out: Text STOP to end. You may also reply STOP ALL, CANCEL, UNSUBSCRIBE, or QUIT. You will receive one final message confirming your opt-out.

Eligibility: You must be the account holder or authorized user of the number provided.
Carriers: Carriers are not liable for delayed or undelivered messages.
Support hours: Messaging support is available during standard business hours.
Mobile data privacy: We do not share mobile phone numbers with third parties for their marketing or promotional purposes. Opt-in data and consent for text messaging will not be shared with any third parties. Information may be disclosed to service providers solely to support our services (for example, message delivery and customer support).
9) Appointments, Scheduling, and Changes
Scheduled appointments may be rescheduled or canceled subject to availability and our then-current policies. We will make reasonable efforts to notify you of changes.
10) Pricing, Payments, and Refunds (If Applicable)
If fees apply to certain services, prices will be provided before you authorize payment. You agree to pay all charges incurred by you or your account. Unless otherwise stated in a written agreement, payments are non-refundable once services are rendered or reserved resources have been allocated.
11) Third-Party Services
Our services may reference or integrate third-party tools or providers. We do not control and are not responsible for third-party services. Your use of such services is governed by those third parties’ terms.
12) Privacy
Your use of the services is subject to our Privacy Policy, which describes how we collect, use, and safeguard personal information, including mobile messaging data. We implement reasonable administrative, technical, and physical safeguards; however, no system is completely secure.
13) Intellectual Property
All content and materials on the services, including text, graphics, logos, and software, are owned by or licensed to Refuge Memorial and protected by law. You may not copy, modify, distribute, or create derivative works except as expressly permitted.
14) Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
15) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, REFUGE MEMORIAL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100).
16) Indemnification
You agree to defend, indemnify, and hold harmless Refuge Memorial and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the services, your content, or your violation of these Terms or applicable law.
17) Dispute Resolution; Arbitration; Class-Action Waiver
You and Refuge Memorial agree to attempt informal resolution of any dispute for 30 days. If unresolved, any dispute, claim, or controversy arising out of or relating to these Terms or the services will be settled by binding arbitration on an individual basis. You and Refuge Memorial waive the right to a jury trial and to participate in a class action or class-wide arbitration. This section does not apply to claims that cannot be arbitrated as a matter of law or to actions for injunctive relief.
18) Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Subject to Section 17, the exclusive venue for any permitted court action is the state and federal courts located in Los Angeles County, California.
19) Changes to These Terms
We may update these Terms from time to time. The “Effective Date” above will reflect the latest version. Your continued use of the services after changes take effect constitutes acceptance of the updated Terms.
20) Termination
We may suspend or terminate your access to the services at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, Sections that by their nature should survive (including intellectual property, disclaimers, limitations of liability, indemnification, dispute resolution, and governing law) will survive.
